When The Chief Justice of India Speaks – In Favour of Injustice! And “There Will Be No Peace – Till There Is Justice,” as Peter Tosh sang so long ago... : Take #5


“Without economic democracy, political democracy will be in peril in the country” – so said the Chief Justice of India (CJI) in a boxed item right on top of the front page of today’s Hindustan Times. What is “economic democracy”?

Whereas political democracy is “one man one vote,” economic democracy is the “rupee vote” – so, the more rupees you have, the more the votes you can cast in THE MARKET, which is to economic democracy what the polling booth is to the other one.

There is one VITAL DIFFERENCE between The Market and the polling booth that must be noted at the very outset: and that is, when you return from The Market after having voted for many goods and services with your rupees, you come home BEAMING, and when you unpack all the shopping bags and lay out your goodies you feel ECSTATIC.

This is verily the PURSUIT OF HAPPINESS - and even if you start off poor, with very few rupee votes, you are possessed of the INCENTIVE towards SELF-IMPROVEMENT: saving, investment, and personal effort.

On the other hand, when you emerge from the TAX-FUNDED polling booth, all you have to show off is an INDELIBLE BLACK MARK on your finger!

INDELIBLE BLACK MARK on your skin! 

And what do you get in EXCHANGE of that? But more and more of The State, more and more legislation, more and more taxation, more meddlesome bureaus, more interventionism - none of which you can EVER VOTE OUT, because your one silly vote, equal to that of all others, of course, simply doesn't count.

And then, they offer you WELFARE DEPENDENCY!



So, give me the INEQUALITY of economic democracy in The Free Market any day. 



Now, look at what is happening in The Market today with inflationism? Since the savings of the poor are being eroded, their rupee votes are being reduced; and as for the corporates who borrow, their votes are increasing all the time.

INJUSTICE!

Oddly enough, the above statement by the CJI was appended to a story titled “New Companies Bill soon: PM”! What did all the old ones do?

Legislation: Companies Act, RBI Act, “Funny Money” as Legal Tender…


The reader was also directed to Page 10 for what the CJI has spoken on Foreign Direct Investment (FDI) and the need for more jobs – and right on top of that page is a big report on a speech of his.

Referring to the Comptroller and Auditor-General’s Report on allocations of the 2G spectrum and coal mining blocks, the CJI made a very ERRONEOUS STATEMENT against the CAG and in favour of the government-of-the-day: that the “losses” in the CAG Report are only “presumptive,” because “loss is a matter of fact while profit is a matter of opinion.” Actually, both profit as well as loss are based on “arithmetic calculation” – which is why the CAG is designated our The State’s “ACCOUNTANT.”

It is VALUE that may be called “presumptive,” at least to the observer, and hence beyond any “cardinal calculation,” because it is “subjective” and lies WITHIN the valuing mind. Thus, only because ganja is illegal, I spend huge amounts on it – because MY MIND values The Buzz this Holy Herb gives MY HEAD even HIGHER.




The CJI also spoke in favour of “inclusive growth” – the big buzzword of our socialists – muttering about the need to “dispel fears among tribals and farmers that equates development with displacement.” And just below that the reporter writes the CJI said, “natural resources should be allocated or distributed for the common good to achieve economic democracy.”

Now, THINK!

When natural resources like the spectrum or coal are allocated or distributed PURPORTEDLY for the “common good,” those who do this distributing and allocating possess the authority to do so only because of “political democracy.”

On the other hand, rupee votes in the economic democracy of The Market are entirely based on Private Property: the more rupees YOU POSSESS!

Thus, political democracy, based on Constitutional Authority, uses FORCE; while economic democracy is entirely CONSENSUAL.

NO FORCE is used in the admittedly UNEQUAL economic democracy of The Market.




The HIGHEST DEGREE OF DISORDER we are witnessing today is just a symptom of SOCIALIST INJUSTICE – which Bastiat called “legal plunder” in The Law, and I termed RAPE.

Imagine – millions of poor tribals and farmers equate development with displacement! If socialists use Constitutional Authority to forcibly “acquire” their lands, will they not rise in OPEN REBELLION?

WON’T YOU?

All order depends on the Inviolability of Private Property – as I recently pointed out.

Further, this Principle is the Key to Justice because only then will all consensual trades be free, which implies ex ante justice – not as something required from any CJI, but as an “attribute of individual conduct.”

PRIVATE LAW SOCIETY – the only way out.

“There will be no Peace – until there is Justice,” as the old Peter Tosh song goes.

Thus, in the admittedly UNEQUAL economic democracy, if anyone with Big Bucks wants some poor tribal or farmer’s land in order to build a highway, a power plant, a factory or whatever, he CANNOT USE FORCE, and will therefore have to part with much of those Big Bucks of his in order to achieve a “consensual transfer of property” – which is ex ante JUSTICE.

Since the transfer of property is consensual, there is NO LEGAL DISPUTE requiring the services of lawyers and “bureaucrat-judges,” and because this agreement is arrived at prior to the transfer, justice is ex ante, and an “attribute of individual conduct.”

PEACE!

NOTE: A “Deed of Sale” transferring ownership of Property from Poor Tribal to Big Bucks is very much “private law” because two private parties have signed this into law – since BOTH GAIN from this transfer.

When the FORCE of political democracy is used, in stark contrast, the Poor Guy LOSES.

Socialism is INJUSTICE!

Socialism is LEGAL PLUNDER!

Socialism is UNLAW!

Socialism is ANTI-SOCIAL!

Socialism causes THE HIGHEST DEGREE OF DISORDER!



Two great columns in the Sunday HT – first, Indrajit Hazra on the “politics” between Manmohan Singh and Mulayam, referring to Amar Singh’s role in supporting UPA1 over the US nuclear deal when the commies deserted. Critical, unbiased, non-partisan and cutting.

The other is by Manas Chakravarty, ridiculing Manmohan’s sudden “Big Bang Reforms.” Very witty as well – and since it comes from an economic journalist, all the more pertinent.

As for the Sunday ToI, I found Swaminathan Aiyar missing the point entirely while championing “cheap Chinese imports” – and that is, if each and every “nation-state” retreats behind tariff walls and then sends “diplomats” to negotiate trade at the WTO with “political instructions” saying exports must be promoted and imports discouraged, the inevitable result will be that every “national economy representative” at these “political negotiations” will want to “export everything and import nothing.” The economy of the whole world will crash – precisely what is happening right now, and exactly what has been going on throughout the disastrous 20th century. Try and imagine not only how much we Indians, those in the Soviet Union and East Germany etc. lost as consumers, but also how much business the West lost as well.

And neither they nor we have learnt the lesson.
 
I wrote “Obamanomics Impoverishes the World” about his opposition to what he calls “exporting jobs” while it is actually Capital that is being exported and “cheap services” that are being imported. This is good for AMERICAN CONSUMERS!


Heads of States, Politicians, Diplomats – OUT of international trade.

UNILATERAL FREE TRADE – based on the logic of every Individual, who exports one good or service, and imports everything he needs from The Market; who “works” only in order to “consume” these goods; and who most definitely does not require any “national economy representative” to FORCE any economic decisions on him based on authority conferred by “political democracy.”

The CONSUMER is KING – only in a Free Market.

COMPETITION IS LIBERTY!
AND THE ABSENCE OF COMPETITION IS TYRANNY!

Another reason why “small is beautiful” – because people in small coastal republics will never support protectionism; while in huge nations with huge markets, there are enormous “political market” favours to be purchased by those crony swadeshi businessmen who employ the “indirect force” of The State’s Customs Department at the taxpayers’ expense in order to CHEAT DOMESTIC CONSUMERS.

The idea of consensual trades implies that such corrupt political market practices where “indirect force” is employed never occur.

ABOLISH THE CUSTOMS DEPARTMENT.

UNILATERAL FREE TRADE.

PEACE WITH ALL OF HUMANITY.

JUSTICE.


CONCLUSION:

All this implies that we have lost our “moral sense” – and both Law as well as Economics are “moral sciences,” in the precise sense that both must answer the question whether private property, and consensual trades which follow from this natural institution, are moral. It is by exploring this moral question that my “Re-assessment of Jawaharlal Nehru” arrived at the conclusion that he was actually an EVIL MAN.

The root causes of the perpetuation of these moral, legal and economic errors are: first, the specialization of modern university education, which separates all these subjects; and second, the same old “positivism” that has converted the study of Law into the memorization of “enacted legislation”; and the study of Economics into nothing more than “measurements” of national economy statistical data.

I have also recently shown how the French destroyed society by destroying what they called “sociology.” Instead of freedom, their false sociology was directed towards achieving socialism by converting a free people into innumerable "hierarchical organisations" empowered through interventionist legislation. I have also discussed what the True Sociology is all about: Individualism, Private Property, Liberty and a Natural Order.


There is no solution – but the progressive enlightenment of mankind.

Mankind requires GOOD TEACHERS – and not rulers.

They need to know how and why LIBERTY works – and that a NATURAL and UNIVERSALLY BENEFICIAL ORDER prevails on its own.



Finally, after proving the CJI to be favouring injustice, and also favouring the government-of-the-day as against the CAG - what do you think of the socialist lawyer-politician who is our Minister of Human Resource Destruction?

Actually, the WORST CJI India ever had was PN Bhagwati, who inaugurated Public Interest Litigation (PILs) as some sort of "social justice" (like the Right to Information Act) - this, while their existing backlog of ordinary suits is estimated to take over 200 years to settle! 

As for the USELESSNESS of these PILs, one only has to look at the PIL filed by the Indian Liberal Group against the Representation of People Act (legislation that grants "licenses" from an IAS bureaucRAT only to "socialists" to form "recognised political parties" ) - a PIL that has been deliberately kept PENDING before the Bombay High Court for over 15 long years! Bhagwati himself went on to become a Judge at the International Court of Justice in The Hague!

Why do we need this LEGISLATION on representation? 

In Britain, Screaming Lord Sutch set up the Raving Monster Loony Party - and it still campaigns at every election. Hope they win this time!   

Also read this from another CONgress socialist lawyer-politician who is LAW MINISTER, hence boss of all "bureaucrat-judges," insisting that all legal education will remain the monopoly of the socialist Bar Council of India.

The former will teach all the kids CIVICS.

The latter will train UNJUST LAWYERS who alone can become UNJUST BUREAUCRAT-JUDGES!
